Four Libyan Organizations Warn Against Muslim Brotherhood Attempts to Obstruct Elections – Al Marsad

In light of the proposals presented by the Muslim Brotherhood bloc at Libyan Political Dialogue Forum (LPDF) and their insistence on a constitutional referendum which would push elections to 2022—four leading political organizations issue a statement warning them against attempting to derail the election date set by the UN for 24 December 2021.

(Libya, 12 January 2021) – Four political organizations, namely, the Libyan National Movement, Civil Democratic Party, Ihya Libya (Reviving Libya) Movement, and the Centrist Youth Movement, issued a statement in which they warned deliberate procrastination by the Muslim Brotherhood block against the UN announcement the election date to be 24 December 2021.

The four political organizations confirmed in their statement today that the constitutional basis for elections which are already scheduled does not need further controversy because there is a constitutional basis already for these elections (resolution No. 5 of 2014, in addition to the constitutional declaration along with its amendments to the decisions of the February Committee). The statement said that there should be no further delays or arguments that continue to deprive the Libyan people from exercising their inherent and legitimate right to choose their leaders and renew legitimacy of the governing institutions of their country.

The statement pointed out that Resolution No. 5 of 2014 is still binding as a quorum and an absolute majority, and no legitimate legislative authority has invalidated  the resolution. The constitutional declaration was sufficient legal basis to allow previously the holding elections in 2012 and 2014 in Libya, in addition to the decision of the February Committee on the separation of powers and clarification on the powers of each.

The joint statement by the political organizations concluded by saying that “everything we have mentioned saves us from further delays by creating artificial problems on the constitutional rule.”

Statement on the Constitutional Rule for the Elections of 24th of December 2021

In light of the international announcement of the date of the Libyan Presidential and Parliamentary elections on 24 December 2021, and to prevent any further delays or conflicts that continue to deprive Libyan people from exercising their inherent and legitimate right to choose their leaders and renew legitimacy in their country, we emphasize a “constitutional rule” for elections to be held is already established and does not need to open a new controversy.

There is a constitutional basis ready for the elections, which is Resolution No. 5 of 2014, and the Constitutional Declaration with its amendments containing the decisions of the February Committee, which is still binding as a valid quorum, Furthermore, the constitutional declaration was sufficient to hold the Libyan elections twice before in 2012 and 2014, in addition to the decision of the February Committee on the separation of powers and clarification on the powers of each.

Everything we have mentioned saves us from further delay by artificial problems on the constitutional rule.
